An uncontested divorce is a divorce action wherein both parties substantially agree on the need for a divorce and can also substantially agree on the issues of equitable distribution of marital assets and debts, child custody, child visitation and child support. In an uncontested divorce, both parties essentially have "worked out" the issues themselves. Generally, a final order can be obtained in an uncontested divorce after 32 days from the date of filing.
A contested divorce, on the otherhand, is a divorce action wherein the parties cannot agree on one or more issues. For instance, if Husband and Wife both agree that they need a divorce, but cannot agree on who will have custody of the children, the divorce is contested. A contested divorce varies in complexity depending on how divergent the desires of the parties are. Contested divorces may take several months to resolve and may involve extensive discovery, court-ordered mediation, parenting classes and multiple court appearances.
How Much does your firm Charge for a Divorce?
Our firm charges a flat fee for Uncontested Divorces. The actual amount of the fee depends solely on the location of the County wherein the divorce will be filed and whether or not the parties have any children. The higher fees we charge for representing clients in counties outside of Middle Georgia reflects the additional costs of travel and the higher prices for cases involving children reflects the extra work required to adequately handle the case. Generally, the following is a valid price list:
Uncontested Divorce in Middle Georgia (Bibb County, Monroe County, Butts County, Lamar County, Henry County and Newton County).......$500.00+Filing Fee
Uncontested Divorce in Atlanta Area (Fulton County, Cobb County, Dekalb County, Gwinnett County)......$750.00+Filing Fee
Uncontested Divorce in all other counties......$650.00--850.00+Filing Fee
Retainers for Contested Divorces depend on the complexity of the case and whether or not the parties have children. Generally, a retainer for a contested divorce ranges from $2500.00-$5000.00+Filing Fee
Generally, no. However, we have made exceptions in the past in extraordinary situations.
